What About Refusing the Blood or Breath Test?

Refusal of the blood or breath test is a high-risk decision for any driver pulled over for drunk driving in New Jersey. On the one hand, you make it harder for the prosecution to prove a DUI charge. On the other hand, breath or blood test refusal is a violation of the implied consent law, and normally carries with it a license suspension of seven to twelve months - whether or not you're eventually convicted of DUI. Repeated refusals can carry even longer suspensions.
